Biography

Anya Allen is a member of our Litigation & Insolvency and Restructuring team in the Cayman Islands. She has experience in insolvency and restructuring, appraisal litigation under section 238 of the Companies Act, asset tracing and enforcement, and fraud matters. She has appeared at all levels of the Cayman court system from the Grand Court to the Privy Council. Before joining Harneys in 2018, Anya worked at Meredith Connell and at Duncan Cotterill in New Zealand, where she was involved in large-scale asset recovery litigation, Crown matters, and insurance litigation, and appeared as sole counsel before the District and High Courts. Advising Luckin Coffee Inc, in a restructuring in which the company successfully compromised its debts and liabilities in the Cayman Islands and the US through parallel processes which included a scheme of arrangement in the Cayman Islands.

Advising company-side on a number of appraisal arbitrage valuation (s. 238) proceedings, including In re iKang Healthcare Group, Inc. and In re Shanda Games and appearing as junior counsel at the Privy Council;

Advising an award creditor in respect of its international efforts to enforce a substantial arbitral award, including obtaining asset disclosure orders in the Cayman Islands;

Regulatory work advising clients in respect of their obligations under the Monetary Authority Act and ancillary legislation and defence of regulatory enforcement measures; and

Advising liquidators and court-appointed managers on their obligations and asset tracing efforts.
